Conversely, major repairs and extraordinary expenses are the responsibility of the owner, unless they result from the beneficiary\u2019s fault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The draft also requires the beneficiary to exercise the care that a reasonable person would exercise in maintaining the property, while exempting the beneficiary from liability for compensation in the event of loss or damage not resulting from any wrongdoing or negligence on the beneficiary\u2019s part; however, the beneficiary is liable if the property is not returned upon expiration of the term despite having the ability to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Additional Obligations and Allocation of Fees<br><\/strong>The project granted the parties the freedom to choose one of two options regarding fees, taxes, and utility bills during the term of the lease: either the lessee would bear the full cost, or the lessee would be exempt from them, as agreed upon by the parties.<br>The draft also requires the beneficiary to notify the owner when major repairs are needed, or in the event of an encroachment on the property or a claim by a third party to rights over it, or when there is a danger requiring urgent intervention, while granting the beneficiary the right to enjoy the fruits and revenues of the property throughout the term of the contract, subject to the beneficiary\u2019s obligation to return the property or its equivalent upon expiration of the term.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Owner Rights and Protection Mechanisms<br><\/strong>Conversely, the project grants the owner the right to object to any unlawful use of the property or any use inconsistent with its nature, with the option to request additional safeguards if there is a threat to the owner\u2019s rights, In the event of noncompliance, the court has the authority to intervene by expropriating the property from the beneficiary or terminating the right of usufruct, depending on the severity of the situation, while taking into account the rights of third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Termination of the Right of Usufruct and Regulation of Special Cases<br><\/strong>The draft law specifies that the right of usufruct terminates in several cases, including when the owner and the usufructuary are the same person, or when the property is destroyed\u2014in which case the right is transferred to compensation, if any\u2014or when the usufructuary relinquishes the right, as documented in the real estate registry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The draft also permits the inclusion of additional terms and agreements between the parties, provided they do not conflict with the provisions of the model contract;
