Approval of the Real Estate Marketing and Advertising Regulations"},"content":{"rendered":"<p class=\"wp-block-paragraph\">The board of directors of <strong><a href=\"https:\/\/rega.gov.sa\/\">Public Authority for Real Estate <\/a><\/strong>Regulations on Real Estate Marketing and Advertising, based on the Real Estate Brokerage Law issued by Royal Decree No. (M\/130) dated 30 \/ 11\/1443 AH, with the aim of regulating all real estate marketing and advertising practices, promoting transparency, and protecting participants in the real estate market.<br><br>The regulation consisted of twelve articles, which addressed provisions regarding the issuance of licenses for real estate advertisements, requirements for real estate advertising content, related prohibitions, and the obligations of licensees when engaging in real estate marketing activities, as well as the obligations of online real estate platforms. The provisions of the regulations apply to all means of real estate marketing and advertising, including social media platforms, visual, audio, and print media, billboards, exhibitions, events, and online real estate platforms.<br><br>The Authority stated that the regulations require obtaining a separate real estate advertising license prior to publishing any real estate advertisement, and that the application must be submitted by a licensed real estate broker or real estate agency, which must include eight mandatory pieces of information, most notably a description of the property, its condition, and its location, as well as the advertiser\u2019s name, license number (prominently displayed), and expiration date. The regulations also permit the use of a QR code in lieu of providing this information in detail.<br>The regulations exempt those licensed to market an entire real estate project under other regulations from the requirement to obtain a real estate advertising license, including those licensed to engage in real estate contributions, the sale and off-plan leasing of projects, and real estate auctions, provided that the license number is stated and the controls and requirements set forth in the regulations are complied with.<br><br>The Real Estate Authority added that, with regard to online real estate platforms, the regulations impose fifteen technical, legal, and operational obligations on them, most notably technical integration with the Authority\u2019s systems, hosting servers within the Kingdom, verifying advertisers\u2019 accounts through the Unified National Access System, and prohibiting the publication of any unlicensed advertisements, as well as responding to the Authority\u2019s requests within two business days and notifying it at least ten business days in advance of ceasing operations.<br>The regulations prohibit the publication of false or misleading information and the use of the Authority\u2019s identity or that of any government entity without legal justification, and require the removal of an advertisement immediately upon the fulfillment of its purpose or the expiration of its license, whichever occurs first. The regulatory regulations impose penalties for detected violations in accordance with the schedule of classification of violations and penalties set forth in the executive regulations of the system. <strong><a href=\"https:\/\/amlak.net.sa\/en\/67680\/\">Real estate brokerage<\/a><\/strong>.<br><br>These Regulations on Real Estate Marketing and Advertising repeal the Real Estate Advertising Regulations issued by Authority Board of Directors Resolution No. (3\/14\/M\/21) dated 12\/10\/1442 AH, and the Standards for the Licensing and Classification of Online Real Estate Platforms issued by the Authority\u2019s Board of Directors Resolution No. (4\/14\/M\/21) dated 12\/10\/1442 AH, to be replaced by the provisions set forth in these regulations, in line with the development of the legislative framework in the real estate sector, ensuring its effectiveness, and enhancing the efficiency of real estate transactions therein.<br><br>It is worth noting that the General Real Estate Authority released the regulatory guidelines for real estate marketing and advertising in November of last year, 2025, via the \u201cIstislaal,\u201d which enabled the public, government agencies, and the private sector to provide their views and comments on the regulations before they were approved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>According to a report published by the Um al-Qura newspaper, the regulations include the following articles:<\/strong><br>Article I:<br>1. The terms and expressions used in these regulations shall have the meanings specified opposite each of them in Article (1) of the Real Estate Brokerage Law, issued by Royal Decree No.: (M\/130) on 30\/11\/1443 AH, and its implementing regulations, unless the context requires otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. The following terms and expressions\u2014wherever they appear in these regulations\u2014shall have the meanings set forth opposite them:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Real Estate Advertisement: Any content published to promote a real estate product in any visual, print, or audio medium.<br>Licensee: A natural or legal person licensed by the Authority to provide real estate marketing and advertising services.<br>Advertiser: Any natural or legal person who requests the publication of a real estate advertisement.<br>Online real estate platforms: Apps or websites licensed by the Authority that allow for the publication or marketing of real estate listings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article II:<br>These regulations are subject to the provisions, conditions, and requirements set forth in the Real Estate Brokerage Law and its implementing regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article III:<br>The provisions of these regulations apply to all real estate marketing and advertising practices, particularly those conducted through the following channels:<br>1. Social media platforms and channels.<br>2. Visual, audio, or print media.<br>3. Exhibitions and public events.<br>4. Online real estate platforms.<br>5. Billboards.<br>6. Any other means determined by the Authority\u2019s Board of Directors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article IV:<br>1. The following requirements must be met in order to issue a real estate advertising license:<br>A. The advertiser\u2019s information, description, and supporting documents, as specified in the license application form.<br>b. The property title deed number\u2014with the exception of properties under the supervision of government agencies\u2014.<br>c. The real or personal rights to be registered.<br>D. An effective means of communication with the advertiser.<br>2. If the Authority requires any additional information or documents, it shall notify the license applicant, who must then provide the necessary information or documents within a period not exceeding (seven) business days from the date of such notification; otherwise, the application shall be deemed rejected.<br>3. The Authority shall issue a license to the applicant or reject the license application, stating the reasons for the rejection and notifying the applicant accordingly.<br>4. The Authority may revoke a real estate advertising license if any of the following circumstances are established:<br>A. The information provided in his application is inaccurate.<br>b) Discrepancies between the information contained in the permit and the information published in the real estate listing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article V:<br>1. Real estate advertisements\u2014with the exception of those published on online real estate platforms\u2014must include the following information:<br>A. The real or personal rights to be registered.<br>b. A description of the property and its condition, along with its details and location, including information that affects the property\u2019s value or the target\u2019s decision regarding the advertisement.<br>c. Services and rights associated with the property, including any existing disputes regarding it\u2014if any.<br>d. A contact method that matches the information provided when applying for an advertising license.<br>E. Name of the advertiser.<br>f. Include the advertisement license number.<br>g. The expiration date of the advertising license.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H. License number for the licensee to conduct business.<br>2. The content of a real estate advertisement may be limited to the advertisement license number and a QR code that provides access to the data referred to in paragraph (1) of this article.<br>3. The content of real estate listings on online real estate platforms may be limited to listing data retrieved through a technical link to the Authority\u2019s systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article VI:<br>When engaging in real estate marketing, the licensee must comply with the following:<br>1. Accurately identify the property being marketed when presenting it to the public.<br>2. When using advertising and marketing methods, comply with the regulations and instructions issued by the competent authorities.<br>3. Refrain from including inaccurate or misleading information that could disrupt the stability of the real estate market or undermine confidence in it.<br>4. Commitment to the principles of transparency and fairness in the conduct of business.<br>5. Ensure that a valid real estate advertising license is in place for the property being marketed.<br>6. Ensure that all information specified in Article (5) of these regulations is included.<br>7. Remove the real estate advertisement as soon as its purpose has been fulfilled or its license has expired, whichever comes first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article VII:<br>The following are prohibited in real estate marketing:<br>1. Harming others, either directly or indirectly.<br>2. Publishing false information for the purpose of collecting information from recipients or the general public, or for any other purpose.<br>3. Including contact information in the real estate advertisement that does not match the information provided when applying for an advertisement license.<br>4. Using the name, logo, or identity of the Authority, or any other government agency or company, without legal justification.<br>5. Including information in a real estate advertisement that is false or misleading regarding the nature of the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article VIII:<br>When establishing an online real estate platform, the licensee must comply with the following:<br>1. Register the platform and establish a technical connection with the Authority after it has been certified by the Saudi Center for Competitiveness and Business.<br>2. Verifying advertisers' accounts through the National Access System.<br>3. Add real estate listing data based on information retrieved from the Technical Authority\u2019s systems.<br>4. Remove any real estate advertisement that contains misleading information, information that is inconsistent with the facts, or information that gives an impression inconsistent with the nature of the property, as soon as such information is discovered.<br>5. Prohibiting the publication of any unlicensed real estate advertisement.<br>6. Remove the real estate listing immediately upon expiration of its license.<br>7. Update the versions of technical integration processes and procedures in accordance with the Authority\u2019s requirements.<br>8. Provide a page on the platform for receiving complaints, which should include a complaint form, the complaint reference number and date, the actions taken in response, and the time taken to resolve it.<br>9. Not allowing users to modify the content of a real estate listing after it has been published.<br>10. Respond to requests from the Authority for user information within (two business days).<br>11. The platform server must be hosted in the Kingdom.<br>12. Notify the Authority at least (10) business days prior to ceasing operations or changing the platform\u2019s operating model, counting from the date of cessation or change.<br>13. Delete all data and information related to the content of real estate advertisements upon ceasing operations.<br>14. Remove any content that violates the provisions of the system and its regulations, as well as the platform\u2019s terms and conditions of use.<br>15.
