Can others enter this field? And what is the difference between an advertisement published through influencers and one placed through a real estate broker?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong> Key Areas for Inquiries<\/strong><br>He added that after collecting and analyzing all the questions, it became clear that they centered on three or four main themes, the most important of which are: the difference between advertising and marketing; when content is considered an advertisement or a real estate activity that may only be conducted through a Saudi broker; and the question of whether non-Saudis should be allowed to engage in real estate brokerage.<br>He noted that these points will be addressed in detail, but first it is necessary to provide an overview of the regulations governing real estate marketing and advertising.<br>He addressed an important and frequently asked question: Why were these regulations issued at this particular time? Was it in response to a specific circumstance? He explained that observers and experts are aware that the regulations were previously posted on the \u201cIstislaal\u201d platform last November\u2014about six months ago\u2014 and that numerous comments and observations were received from various parties\u2014including the private sector, individuals, companies, and practitioners\u2014and these comments remain archived on the platform.<br>He explained that after the public comment period ended, the regulations were approved by the Authority\u2019s Board of Directors and then officially published in the \u201cUmm al-Qura\u201d newspaper, at which point they took effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Real Estate Brokerage and Services System<br><\/strong>He then moved on to discuss the concept of real estate legislation, explaining that it consists of a framework prepared by the Authority and submitted for approval in accordance with official procedures, after which it is promulgated by a decision of the Council of Ministers. He noted that this system requires the issuance of implementing regulations that interpret its articles and provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this context, a spokesperson for the Real Estate Authority explained that the regulation relevant to today\u2019s topic is the Real Estate Brokerage and Services Regulation, which is a comprehensive set of regulations governing a number of real estate activities, including advertising, marketing, and brokering transactions, in addition to other services such as facility management, property management, consulting, analysis, and real estate auctions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Al-Mufarraj emphasized that the existence of these activities requires the issuance of separate regulatory regulations for each activity, which explains the issuance of previous regulations such as the Auctions Regulation, the Consulting and Analysis Regulations, and the current regulations on real estate marketing and advertising, noting that other regulations will be proposed later via the Isti'lal platform and then adopted and announced.<br>He emphasized that the current regulation is not new, but was proposed several months ago and was officially approved today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Three Key Pillars of the Regulations<br><\/strong>He explained that the regulations are based on three fundamental pillars:<br><strong>The first pillar is prior authorization<\/strong><br> No real estate advertisement may be published before obtaining a license issued by the Authority; this license is separate from the business operation license (FAL license) and is granted for each property individually. He noted that a real estate agent needs a license to practice, in addition to a brokerage contract, as well as a separate advertising license for each property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He explained that the reason for requiring a license for each property is that properties vary in terms of location, price, and description, which necessitates ensuring that every advertisement is based on accurate and reliable data from the real estate registry, with the license number clearly displayed in the advertisement to enable verification.<br>He also explained that there are cases that do not require a separate advertising license, such as real estate contributions, off-plan sales and leases, or auctions, where the project or auction license is sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The second pillar is full disclosure<br><\/strong> The regulations include a set of mandatory details that must be included in the advertisement, such as the rights associated with the property, its description, location, condition, and related services, and any existing disputes, in addition to contact information that matches the license, the advertiser\u2019s name, the advertising license number, its expiration date, and the practice license number.<br>He noted that it would be sufficient to include the license number alongside a QR code containing all the details, to avoid distorting the layout of the advertisement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The third pillar is the immediate removal of the advertisement<br><\/strong>The listing must be removed once its purpose has been fulfilled or the license period has expired, and real estate platforms are required to do so automatically.<br>He emphasized that the regulations apply to all forms of advertising without exception, whether through social media, broadcast media, exhibitions, billboards, or online platforms.<br>He also explained that the regulation defines \u201cadvertisement\u201d broadly to include any content through which a property is published or promoted.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img alt=\"\" loading=\"lazy\" decoding=\"async\" width=\"649\" height=\"1024\" src=\"https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-649x1024.jpg\" class=\"wp-image-104661\" srcset=\"https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-649x1024.jpg 649w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-190x300.jpg 190w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-768x1212.jpg 768w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-974x1536.jpg 974w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML-8x12.jpg 8w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2026\/05\/HHf8lmVW4AAD4ML.jpg 1298w\" sizes=\"auto, (max-width: 649px) 100vw, 649px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>The Difference Between a Promotional Ad and a Real Estate Listing<br><\/strong>Regarding the difference between promotional advertising and real estate activities, he explained that advertising is considered a real estate activity if it involves direct communication with clients or acting as a broker, which requires a license and is restricted to licensed Saudis. Advertising through media outlets or influencers, however, is considered merely a means of promotion, provided that the license number is displayed and no brokerage activities are conducted.<br>He emphasized that an unlicensed advertiser is not authorized to receive communications or negotiate with clients, as this constitutes the practice of brokerage.<br>He noted that all advertising channels lead to a licensed real estate broker, as no party may advertise a property without going through an accredited broker who issues the advertising license.<br><br><strong>The Most Important Prohibitions<br><\/strong>He also addressed the most significant prohibitions, such as publishing false information, using different contact details, defaming others, using official logos without permission, or providing misleading information about the property. He also addressed the obligations of real estate platforms, explaining that they include technical, regulatory, and operational aspects, such as linking the platform to the authority, verifying licenses, removing non-compliant listings, and providing channels for complaints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He noted that in some cases, a separate advertisement license is not required if there is a comprehensive license for the project, provided that the license number and basic information are displayed. Regarding violations, he explained that penalties are imposed in accordance with the approved schedules, starting gradually and potentially reaching substantial fines, with the possibility of license revocation in two cases: first, if the information provided during the advertisement licensing process is found to be false, or if the advertisement contains information not included in the
