A blame game begins between the developer, contractor, and consultant, while the project manager finds himself at the heart of the conflict, even though many of the decisions that led to the delay may not have been made by him at all.<br>Here arises a legal question that deserves consideration: Does the project manager bear responsibility for everything that happens within the project, or does his responsibility stop at the limits of the powers granted to him by the contract?<br>This question is not limited to <strong><a href=\"https:\/\/amlak.net.sa\/en\/90195\/\" data-type=\"post\" data-id=\"90195\">Judicial disputes<\/a><\/strong>Rather, its effects begin at the stage of preparing contracts, because many of the problems that arise during implementation are the result of ambiguity in the distribution of roles among the project parties, rather than being the result of a systematic violation or technical error.<br><br><strong><a href=\"https:\/\/www.jisr.net\/ar\/templates\/project-manager-job-description\">Project Manager<\/a> Operational tasks <br><\/strong>The practical reality shows that <strong><a href=\"https:\/\/www.jisr.net\/ar\/templates\/project-manager-job-description\">Project Manager<\/a><\/strong> He or she becomes the link between the owner, developer, contractor, consultant, and supplier, overseeing the timelines, coordinating between the various teams, monitoring the quality of execution, managing risk, reporting, and following up on contract compliance. As this role has expanded, some parties have come to believe that the project manager is responsible for everything that happens within the project, a perception that is not always based on a legal foundation.<br>Legal liability is not based on the number of meetings attended by the person, or on being the most visible figure in the project; rather, it is based on the commitment accepted, the authority granted by the contract, the decision the person has the right to make, the mistake proven to have occurred, and the relationship between that mistake and the damage caused.<br>One of the most common causes of real estate disputes is the confusion between technical supervision, contractual management, and decision-making. The project manager may have the authority to monitor and coordinate without having the authority to approve modifications, issue change orders, accept or reject work, and his role may be purely advisory. In contrast, some contracts may grant him broad powers that make him responsible for decisions that directly affect the rights and obligations of the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Controversial contractual models<br><\/strong>Therefore, the job title alone is not sufficient to determine responsibility, because the judiciary does not judge titles; it looks at the content of the contract, the limits of obligations, and the nature of the powers that have already been granted, and how they are exercised during project implementation. Moreover, many disputes arise because general contractual models are adopted that do not reflect the nature of the project or clarify the relationship between the project manager and the other parties. When a deadlock occurs, each party tries to interpret the contract in a way that serves their own interests, overlapping responsibilities, and making it difficult to determine which party caused the damage through their actions or omissions.<br>Therefore, precise contractual drafting has become part of risk management, and not just a means of organizing the relationship between the contractors. Any undefined authority, and any unclear commitment, represents a pending dispute rather than a contractual text. No less important is the documentation of decisions, correspondence, and meetings, because project management is measured not by what is said verbally, but by what can be proven when a dispute arises. Many responsibilities are determined by meeting minutes, work instructions, change approvals, and a chain of correspondence that reveals who made the decision, who approved it, and who had the power to veto it or stop it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Clarity of responsibilities and the governance of powers<br><\/strong>Therefore, the success of the real estate project does not depend solely on technical competence; it also depends on the clarity of responsibilities, the quality of contracts, the governance of authority, and the documentation of procedures, because a project in which each party knows the limits of their role reduces the chances of conflict no matter what challenges they face.<br>The bottom line remains that the project manager is not responsible for everything that happens within the project; nor is he exempt from responsibility simply because he did not carry out the work himself.
