The Tourist Guidance Regulation, published in the official newspaper \u00abAm al-Qaraa\u00bb, emphasized the need to ensure accuracy in the information provided to tourists, and not to provide any misleading information that contradicts the facts or harms the reputation of the Kingdom and its interests. The regulation regulates obtaining a license to practice tourist guidance activities, its requirements and procedures, as well as the ongoing obligations of the licensee. The activity may not be carried out without obtaining the license, after its termination, cancellation, suspension, or when one of its conditions is lost.

Two categories of licensing<\/strong>
The regulation has identified two categories of licensing: \u00abRegional Tourist Guidance\u00bb to provide service in a specific administrative region as approved by the Ministry, and \u00abSpecialized Tourist Guidance\u00bb to provide service in a specific specialty or location, with the possibility that the license may include more than one category, region, specialty, or location.
When applying for the license, it was required that the applicant be a Saudi national, be under 18 years of age, and not have any health condition that prevents them from performing the activity. In addition, they were required to submit a certificate of no criminal record and a certified first aid certificate, proof of proficiency in the non-Arabic language(s) intended to be taught, and to pay the specified fee.
The license applicant must also pass the courses and exams approved by the Ministry of Tourism according to the category of license required, or provide equivalent documents as determined by the Ministry. The validity of the license shall not exceed 3 years, renewable.
The regulation requires the licensee to refrain from using the ministry\u2019s name or logo in any advertisement or marketing activity unless it has obtained the ministry\u2019s approval, to respond to the ministry around the clock, to obtain the necessary permits and approvals to visit the sites that require them, to provide the service according to the license category, and not to allow others to use the license.<\/p>\n\n\n\n

The regulation also stipulated that the license be suspended for the entire period of providing the tourist guidance service, and that the license number, category, and language used in the guidance be included in advertisements, websites, and electronic platforms, while adhering to the regulations and policies of the sites where the activity is carried out. The regulation also limited the practice of tourist guidance to accompanying tourists and providing them with tourist information, without providing services that require another license; it also required the licensed person to adhere to the permitted number of tourists, use the languages specified in the license, and attend the qualification and enhancement programs determined by the ministry.
The regulation emphasized the need to ensure accuracy in the information provided to tourists, not providing misleading or factually incorrect information, and not harming the reputation of the Kingdom and its interests, as well as adhering to politeness and respect in dealing with tourists, and not soliciting commission, reward, gift, or service from them. Tourists <\/a><\/strong>Or the establishments with which they deal while performing the activity. It also prohibited dealing with unauthorized or unlicensed individuals from the ministry or the competent authorities, and required the licensed entity to document the website from the competent authority when advertising or dealing through its website.<\/p>\n\n\n\n

Regarding prices, the regulation requires the advertising of the price of the tourist guidance service in both Arabic and English languages when it is displayed on websites and electronic platforms, with the fees associated with the service, if any, being included.

Protection of tourist data <\/strong>
It also emphasized the protection of tourist data and its privacy, informing them when their missing belongings are found, and not providing guidance services in military, border, customs, or other locations that require prior permission without obtaining it in advance, as well as not providing or arranging transportation services for tourists except through a licensed travel and tourism service provider.
When making a direct agreement with the tourist, the regulation requires the licensed entity to inform them of the service, price, fees, payment mechanism, cancellation, refund, and modification, as well as their rights regarding rescheduling the service, changes due to extraordinary circumstances, and force majeure, and to issue a booking document containing the details of the service, price, dates, duration, terms of booking, cancellation, refund, and modification, as well as contact information for the ministry.<\/p>\n\n\n\n

The licensed entity was also required to provide a variety of payment methods, including credit card payments via Visa and MasterCard, with refunds being made according to the specified terms; refunds for payments made via cash payment will be immediate, and 30 days for payments made via approved point-of-sale devices or electronic means.
In the event that the agreed-upon service cannot be provided, the tourist must be informed immediately and given the choice between refunding the amount paid without deducting fees, or rescheduling the service for another day with his written consent, without imposing any additional charges.
The practice of tourism guidance activities is subject to inspection, and penalties are applied for violations in accordance with the schedule of violations and penalties for tourism activities.<\/p>\n\n\n\n

Modification of the conditions of licensees<\/strong>
The regulation included a mechanism to modify the status of former licensed operators to engage in tourist guidance activities, with the modifications to be made within a period not exceeding 180 days from the date of entry into force of the amended regulation, or until the expiration of the license, whichever comes first, through the electronic portal. Under the mechanism, the \u00abSpecialized Tourist Guide\u00bb category remains unchanged, while the \u00abSpecialized Tourist Guide Route\u00bb category is modified to \u00abRegional Tourist Guide,\u00bb with the possibility of being modified to \u00abSpecialized Tourist Guide\u00bb for routes requiring specialization within a specific geographical scope, while the \u00abSite Tourist Guide\u00bb category is modified to \u00abSpecialized Tourist Guide.\u00bb.
Modifying the license category does not entail paying the Ministry a financial fee or changing the date of the license\u2019s validity. The licensee is required to submit a certificate of no previous record. Licensees in the category of \u00abTourist Guide Route\u00bb who are included in the modification to the category of \u00abTourist Guide Area\u00bb must complete the courses or exams approved for this category or equivalent as determined by the Ministry.
