The draft also provides additional flexibility by allowing for exceptions to this procedure in certain cases, subject to the approval of the relevant ministerial committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This proposed text represents an evolution from the current wording of Article Thirteen of the Executive Regulations, which was limited to cases of sale by stating that \u00abwhen the taxpayer wishes to sell the land before the completion of the development, the payment period expires and he is obligated to pay the fees before transferring ownership,\u00bb as the new wording is more comprehensive for the majority of transactions transferring ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These amendments fall under the requirements of Cabinet Resolution No. (263), issued on August 25, 2026, and published in the Official Gazette &quot;Umm Al-Qura&quot; in September of the same year. The resolution mandates the Ministerial Committee to develop regulations and procedures governing the documentation of real estate transactions, ensuring the preservation of the state&#039;s rights to collect outstanding dues on land, without hindering development in cases that do not involve a transfer of ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is the system for charging for white land?<br><\/strong>The White Land Fee System is a system that imposes an annual fee on the (undeveloped) space land located within the urban boundaries of cities, with the aim of incentivizing its owners to develop it or market it, rather than keeping it unused.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the most notable new amendments is raising the annual fee to 10% of the value of the land in the priority plot for urban development, 7.5% in the high priority plot, 5% in the medium priority plot, and 2.5% in the low priority plot, while fees are not imposed on lands outside the priority plots, but are calculated as part of the owner\u2019s total area. The minimum area subject to the fee has also been reduced to 5,000 square meters or more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Objectives of the White Lands Fee<br><\/strong>Increasing the supply of developed land and residential units.<br>Achieving balance between supply and demand in the real estate market.<br>Reducing the inflation of land and real estate prices.<br>Combating monopolistic practices (monopolizing land without developing it).<br>Protecting fair competition in the market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conditions for subjecting land to taxation<br><\/strong>To be a white land (undeveloped space).<br>To be located within the approved urban area.<br>The area (or the total area of the owner's land in the city) must not be less than 5,000 m\u00b2.<br>To be capable of being developed or built upon.<br>To be within the ranges announced by the ministry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is worth noting that the regulation was first issued by Royal Decree No. (M\/4) dated 12\/2\/1437 AH (November 2015) and came into effect in 2017.
