Select The Vacant Land and Vacant Real Estate Program<\/a><\/strong> The Ministry of Municipalities and Housing has 7 cases that are not subject to the usual restrictions on documenting real estate transactions that transfer ownership of lands subject to fees, in accordance with specific regulatory conditions and procedures, aimed at regulating real estate transactions and taking into account cases related to development, investment and judicial rulings.<\/p>\n\n\n\n

The program explained that the cases include the taxpayer providing the land subject to the fee in full as an in-kind share in the capital of a real estate investment fund, in accordance with the provisions of the Capital Market Law and the regulations and instructions issued thereunder.<\/p>\n\n\n\n

The cases also included the division of the estate among the heirs, with the condition that no real estate transaction transferring ownership of the land after its distribution among them should be documented, except after the payment of the fees due from the deceased.<\/p>\n\n\n\n

Exceptions related to land development<\/strong><\/h2>\n\n\n\n

The regulations included allowing the transfer of land ownership when the taxpayer obtains an additional grace period to complete its development, and his desire to sell it to a buyer who undertakes to complete the development or construction work during the granted period, provided that the land is not disposed of before its development or construction, and that the relevant procedures are submitted to the Ministry.<\/p>\n\n\n\n

The program also allowed the sorting or merging of land subject to fees if it was owned by more than one taxpayer, and converting it into a group of land or a single plot owned by the same owners, for the purpose of developing it, provided that no real estate transaction transferring ownership of the land resulting from the sorting or merging is documented except after the payment of the imposed fees.<\/p>\n\n\n\n

Judicial rulings and projects on the map<\/strong><\/h2>\n\n\n\n

Also among the excluded cases are real estate transactions based on court rulings, as the regulations stipulate that the value of the fees be kept through a separate bank check, according to what is included in the ruling, with the competent judicial department, provided that the amount is deposited into the account of the White Land and Vacant Real Estate Fees Program at the Saudi Central Bank.<\/p>\n\n\n\n

The exceptions also include transactions transferring ownership that take place within the framework of implementing approved real estate projects under off-plan sales and leasing programs, provided that the regulations and procedures governing this type of project are adhered to.<\/p>\n\n\n\n

Government actions and expropriation<\/strong><\/h2>\n\n\n\n

With regard to transactions related to government entities, the program excluded real estate transactions in which the state is a party, as well as transactions resulting from the application of the expropriation of real estate for public benefit system, and procedures for temporary seizure of real estate.<\/p>\n\n\n\n

These exceptions are part of the regulations governing dealings with lands subject to white land fees, allowing for the handling of special cases, while ensuring compliance with regulatory and financial requirements, and achieving a balance between the rights of owners and the requirements for land development and enhancing the efficiency of the real estate market.<\/p>\n\n\n\n
