The Ministry of Justice has entrusted the documentation of the assignment of inheritance shares in all estates to the jurisdiction of the second notaries or their employees, without linking this to the emptying of the relinquished property in order to resolve the dispute, given the impossibility of taking note of all the objects of the estate, so the new mechanism was adopted, this came after a study prepared regarding what the Ministry received from the notaries to the need to document the assignment.<\/p>\n
The ministry added in a circular - a copy of which was obtained by Amlak - that the second notary will document the waivers and consensual division of the fixed and movable estate, provided that the known objects of the estate are mentioned according to the acknowledgment of the parties, without refraining from documenting the waiver of the entire estate, both known and unknown.<\/p>\n
The deed shall be delivered to the assignee and shall be a document in the transfer of the ceded share and the emptying thereof at the competent notary public, with the continuation of the work of the previously issued deeds of general assignment in the estate based on the directive, and the Ministry concluded its circular by implementing the directive without prejudice to the right of the stakeholder to file his claim before the competent court in case of deception or fraud.<\/p>\n
