{"id":22247,"date":"2018-10-31T10:22:55","date_gmt":"2018-10-31T07:22:55","guid":{"rendered":"https:\/\/www.amlak.net.sa\/home\/?p=22247"},"modified":"2018-10-31T10:22:55","modified_gmt":"2018-10-31T07:22:55","slug":"%d8%a7%d9%84%d8%a5%d9%85%d8%a7%d8%b1%d8%a7%d8%aa-%d8%aa%d8%b5%d8%af%d8%b1-%d9%82%d8%a7%d9%86%d9%88%d9%86%d8%a7%d9%8b-%d8%a7%d8%aa%d8%ad%d8%a7%d8%af%d9%8a%d8%a7%d9%8b-%d9%8a%d9%85%d9%86%d8%b9-%d8%a7","status":"publish","type":"post","link":"https:\/\/amlak.net.sa\/en\/22247\/","title":{"rendered":"UAE issues a federal law banning the disposal of all real estate properties belonging to the government It excludes endowments"},"content":{"rendered":"<p>Sheikh Khalifa bin Zayed Al Nahyan, President of the United Arab Emirates, issued Federal Decree-Law No. (16) of 2018 yesterday regarding the real estate holdings of the federal government.<\/p>\n<p>The decree stipulates that no federal government entity may dispose of any federal property except with the approval of the Ministry of Finance, unless a decision to that effect is issued by the Council of Ministers, as the Ministry of Finance is authorized to designate the government entities that may use any federal property, in accordance with the provisions of this decree-law and the decisions implementing it.<\/p>\n<p>According to an official statement, the provisions of this decree-law apply to all federal government property both within and outside the country, including real estate, including vacant land registered in the name of the government or a federal government agency and designated for public use, or any real right over real estate, unless this conflicts with bilateral or international agreements in force in the country.<\/p>\n<p>The provisions of this decree shall not apply to endowed properties, the administration of which is entrusted to the General Authority for Islamic Affairs and Endowments or to any other federal government entity, or to any federal entity or federal property designated by a decision of the Council of Ministers.<\/p>\n<p>The Decree-Law defines the Union\u2019s property as follows:<\/p>\n<p>\u2013 Real estate and vacant land granted by one of the emirates to the government or any federal government entity.<\/p>\n<p>\u2013  Property owned by the government or any federal government agency.<\/p>\n<p>\u2013  Property granted or transferred by any natural or legal person to the government or any federal government agency.<\/p>\n<p>The key points of the decree-law are as follows:<\/p>\n<p>\u2013  Prior approval from the Ministry of Finance is required for any request by a federal government agency to lease real estate used by that agency, in accordance with the policies and procedures regarding the leasing of government buildings adopted by the Cabinet.<\/p>\n<p>\u2013 Registering the Union\u2019s property in the name of the government in the real estate registries maintained by the competent local authority or the country where the property is located.<\/p>\n<p>\u2013 The Ministry of Finance must maintain a special registry of the Union\u2019s property, with the exception of certain cases involving the State\u2019s diplomatic missions abroad, in which the headquarters of diplomatic missions may be registered in the name of the Ministry of Foreign Affairs and International Cooperation, in accordance with the laws in force in the country where the mission is located.<\/p>\n<p>\u2013 Under this law, entities other than federal government agencies may not dispose of any federal property except with the approval of the Council of Ministers, which also has the authority to decide to demolish, rebuild, expand, or alter the specifications of any federal property, or to transfer it to a third party.<\/p>\n<p>The decree-law clarified the mechanisms for cooperation and coordination between the federal government and the emirates regarding properties that have been transferred from any of the emirates to the ownership of the Union, and established regulations for the recovery of such properties.<\/p>\n<p>The law prohibits any natural or legal person from disposing of any part of the Union\u2019s property except in accordance with the provisions set forth in the Decree-Law, providing for a penalty of imprisonment for a term not exceeding one year and a fine not exceeding one hundred thousand dirhams, or either of these two penalties, for anyone who violates this provision.<\/p>","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading time: <\/span> <span class=\"rt-time\"> 2<\/span> <span class=\"rt-label rt-postfix\">Minutes<\/span><\/span>Sheikh Khalifa bin Zayed Al Nahyan, President of the United Arab Emirates, yesterday issued Federal Decree Law No. (16) of 2018, regarding the real estate properties of the federal government.
