1- Concluding a usufruct contract for a specific period not exceeding 99 years, and concluding this contract through a practicing lawyer licensed in the Kingdom agreed upon by the parties to the contract, in a manner that does not violate the Privileged Residence Law or its executive regulations or the controls approved by the Supervisory Committee of the Privileged Residence Center, provided that the contract is documented at the competent notary after verifying the basis of the real estate deed, and that the legal and statutory procedures are completed and valid.
\n2- After the completion of the procedures, the competent notary shall issue a usufruct deed, and the legal effects of the contract shall take effect after the issuance of the deed, and the beneficiary shall hand over to the owner of the property or his equivalent or his legal representative the usufruct compensation, as the case may be, after documenting the contract, unless otherwise agreed in accordance with this matter.
\n3- Upon completion of the stipulated procedures, the competent notary shall inform the Center for Privileged Residency of what has been done regarding the utilization, through an electronic record established for this purpose in coordination between the Center and the Ministry of Justice.<\/p>\n
1- A detailed description of the property, specifying the purposes of utilizing the property.<\/p>\n
2- Determining the period of utilization, so that it does not exceed the period specified in the Premium Residency Law or its executive regulations.
\n3- Include in the contract that the court that has jurisdiction over any dispute that may arise from the contract is the general court in the location of the contracted property.<\/p>\n
4- If the contract includes installments of the usufruct consideration, the consideration must be specific to the property and the term of each installment must be specified, and if the consideration is deferred, its date must be specified and the obligations of each party to the contract and the cases of its termination must be clarified.<\/p>\n
5. Clarify the obligations of the parties in cases of transfer of ownership of the property or benefit and the compensation mechanism.
\nWhen the property cannot be utilized for any reason.<\/p>\n
6- The signing of the contract shall be considered as a declaration by the owner of the property or his equivalent or his legal representative that the property subject to the contract is free from any third party's right to dispute it, with his commitment to the consequences of the breach of this.
