The Minister of Justice and Chairman of the Supreme Judicial Council, Sheikh Dr. Walid bin Muhammad Al-Samaani, expressed his thanks and appreciation to the Custodian of the Two Holy Mosques, King Salman bin Abdulaziz Al Saud, and His Royal Highness Prince Muhammad bin Salman bin Abdulaziz Al Saud, Crown Prince, Deputy Prime Minister, and Minister of Defense\u2014may God protect them both\u2014for issuing Evidence system<\/a><\/span>.<\/p>\n\n\n\n

The minister expressed his appreciation for the interest and support of His Royal Highness Prince Mohammed bin Salman bin Abdulaziz Al Saud, Crown Prince, Deputy Prime Minister, and Minister of Defense \u2014may God protect him\u2014for the development of a system of specialized legislation that enshrines the principles of justice and transparency and contributes to achieving comprehensive development. He highlighted the contents of His Highness\u2019s statement on the occasion of the issuance of the Evidence Law, and what was stated therein regarding the development of the Kingdom\u2019s legislative framework; this will help improve its quality and enhance the performance of the judicial authorities, given that these laws are fundamental pillars in achieving transparency and justice, and will bring about a major qualitative leap in the judicial legislative framework and establish principles firmly grounded in fixed references in judicial practice\u2014as His Highness noted.<\/p>\n\n\n\n

He explained that among the most prominent objectives of the evidentiary system are the stability of judicial rulings and the expedited resolution of disputes, so that the judge may devote his time to establishing, describing, and proving the facts, and then applying the relevant legal provision to the facts, in addition to achieving preventive justice by encouraging the parties to document their contractual actions in a manner that preserves rights and contributes to maintaining legal status.<\/p>\n\n\n\n

He noted that the evidence system will help increase confidence and assurance regarding contractual obligations, given the existence of provisions that govern and regulate legal statuses, and the establishment of a modern model for judicial legislation that is consistent with the objectives of Sharia and international conventions.<\/p>\n\n\n\n

He concluded his remarks by stating that specialized legislation is based on several foundations, the first of which is its grounding in the provisions, rules, and objectives of Islamic law, followed by consideration of the reality on the ground\u2014including economic, social, and other aspects\u2014while also taking into account comparative international studies and experiences, Consequently, these regulations have been developed into a comprehensive, integrated framework that will have a significant positive impact on the judiciary and on society as a whole.<\/p>","protected":false},"excerpt":{"rendered":"
