Texts of the Articles of the Executive Regulations of the Contractor Classification System"},"content":{"rendered":"<p>The Minister of Municipal and Rural Affairs and Housing, Majid bin Abdullah Al Haqeel, has approved an amendment to<span style=\"color: #800000;\"><strong><a style=\"color: #800000;\" href=\"https:\/\/uqn.gov.sa\/details?p=24330\"> Executive Regulations of the Contractor Classification System<\/a><\/strong><\/span>This regulation replaces the Executive Regulations of the Contractor Classification System, issued on Rabi'II 9, 1443 AH.<\/p>\n<p>In the following lines, we review the text of the executive regulations of the <a href=\"https:\/\/amlak.net.sa\/en\/61976\/\">Classification of contractors<\/a> approved by Al-Haqeel.<\/p>\n<h4><span style=\"color: #800000;\"><strong>Executive Regulations of the Contractor Classification System<\/strong><\/span><\/h4>\n<h4><span style=\"color: #800000;\">Article I:<\/span><\/h4>\n<p>The following words and phrases, wherever they appear in these Regulations, shall have the meanings indicated before them unless the context requires otherwise:<\/p>\n<p>Kingdom: Saudi Arabia.<\/p>\n<p>System: Contractor Classification System.<\/p>\n<p>Agency: The Ministry's agency for regulating city operators.<\/p>\n<h4><span style=\"color: #800000;\">Article II:<\/span><\/h4>\n<p>Subject to the provisions of Article (2) of the Law, all applications shall be decided after all classification requirements have been completed by the contractor within the following period:<\/p>\n<p>1- Classification requests (classification, reclassification, upgrade, addition, deletion, modification) within a period not exceeding (60) working days.<\/p>\n<p>2- Requests (extending the validity of the classification certificate) for a period not exceeding (10) working days.<\/p>\n<h4><span style=\"color: #800000;\">Article III:<\/span><\/h4>\n<p>The classification certificate is issued electronically, and project owners must verify the authenticity of the submitted certificate through the Ministry's website.<\/p>\n<h4><span style=\"color: #800000;\">Article IV:<\/span><\/h4>\n<p>The fields, activities, and degrees of classification shall be defined, amended, and updated by a decision of the Minister in accordance with the following regulations:<\/p>\n<p>First, the classification must be within the following businesses (construction and building, operation, maintenance and services, telecommunications and information technology, food and accommodation, exhibitions and conferences, real estate development).<\/p>\n<p>Secondly: The fields and activities of the classification should be in accordance with the National Directory of Economic Activities.<\/p>\n<h4><span style=\"color: #800000;\">Article V:<\/span><\/h4>\n<p>The contractor submits a request for categorization including the following:<\/p>\n<p>1- Classification models.<\/p>\n<p>2- Commercial register or its equivalent (valid), including the required fields (and activities) of categorization.<\/p>\n<p>3- The statement of financial position (budget) and income statement (profit and loss account) for the last year, certified by a certified public accountant licensed to practice the profession, provided that the financial statements issued in the Kingdom are deposited in the Qawmah program.<\/p>\n<p>4- Organizational structures and governance, and the preparation and expertise of administrative and technical staff.<\/p>\n<p>5- Project contracts (or its equivalent in the absence of a contract) that the contractor has executed or is in the process of executing inside or outside the Kingdom, provided that the project completion rate is not less than (50%) for implementation projects, and (30%) for maintenance, operation and service projects (30%).<\/p>\n<p>6- Any other documents or data required to be submitted as a result of studying and analyzing the classification request.<\/p>\n<p>The above must be submitted in Arabic or translated by an authorized translation office, and all documents submitted from outside the Kingdom must be certified by the Saudi Commercial Attach\u00e9 or the Saudi Consulate or Embassy.<\/p>\n<h4><span style=\"color: #800000;\">Article VI:<\/span><\/h4>\n<p>The contractor's classification certificate is issued for the field (and activity) or fields (and activities) and the degree due, based on the available information and data and the points achieved by the calendar, and a certificate is issued for a period of two calendar years.<\/p>\n<h4><span style=\"color: #800000;\">Article VII:<\/span><\/h4>\n<p>The Contractor shall fulfill the requirements of the categorization forms on the Ministry's website based on the following criteria and conditions:<\/p>\n<p>1- Financial statements (budget), including net income, total income, net property and equipment, total assets, total cash and short-term investments, total current liabilities, total equity, total liabilities, and diversification.<\/p>\n<p>2- Technical and administrative staff (within the Kingdom) and their professional experience, according to the requirements of the technical standards certificate for the activities subject to classification.<\/p>\n<p>3- Information on previous and ongoing projects in terms of the total number, type, and value of projects.<\/p>\n<h4><span style=\"color: #800000;\">Article VIII:<\/span><\/h4>\n<p>The contractor must keep commercial books and documents that prove the validity of the statement of financial position (budget) and the income statement (profit and loss account) for the last year, signed and certified by a certified public accountant licensed to practice the profession, and deposited in the Qawaim program, and the data and explanations that explain them, and the contractor within the Kingdom must keep these books and records in regular order and in the Arabic language and must comply with the conditions and controls contained in the Commercial Books Law.<\/p>\n<h4><span style=\"color: #800000;\">Article IX:<\/span><\/h4>\n<p>If the contractor wishes to be reclassified, he may submit a request to the Agency within (90) ninety days prior to the expiration of the certificate.<\/p>\n<h4><span style=\"color: #800000;\">Article X:<\/span><\/h4>\n<p>The validity of the certificate shall be extended for (90) ninety days from the end date of the certificate and for one time only, at the request of the contractor.<\/p>\n<h4><span style=\"color: #800000;\">Article XI:<\/span><\/h4>\n<p>The Agency may cancel the Contractor's application for classification if it does not fulfill the required classification requirements within a period of (90) ninety days from the date of notification.<\/p>\n<h4><span style=\"color: #800000;\">Article XII:<\/span><\/h4>\n<p>The classified contractor may request to amend his valid classification certificate by increasing, adding or deleting the degree in any field (and activity), in accordance with the requirements and classification criteria that support this and for the same period of validity of the certificate, and he shall be classified in a new classification with the degree he deserves based on the available information and data, and the points achieved by the evaluation.<\/p>\n<h4><span style=\"color: #800000;\">Article XIII:<\/span><\/h4>\n<p>If there is any legal change to the contractor's status in the commercial register or its equivalent that affects the classification (trade name, ownership, type, nationality, commercial register number and date, capital), the contractor must apply for an amendment to the classification certificate according to the commercial register or its equivalent, supporting his request with the information and data that support it.<\/p>\n<h4><span style=\"color: #800000;\">Article XIV:<\/span><\/h4>\n<p>The classification services and the financial compensation for them shall be determined by a decision of the Minister in agreement with the Ministry of Finance.<\/p>\n<h4><span style=\"color: #800000;\">Article XV:<\/span><\/h4>\n<p>Specialized employees and inspectors have the right to access data and documents related to classified facilities and applicants for classification, and the contractor must enable them to do so and facilitate their task, and they must maintain the confidentiality of the information and documents they see.<\/p>\n<p><strong><span style=\"color: #800000;\">Article XVI:<\/span><\/strong><\/p>\n<p>Subject to the provisions of Article (14) of the Law, the inspectors shall, in order to carry out the tasks entrusted to them, do the following:<\/p>\n<p>First: Conducting inspection visits to detect violations of the provisions of the law and regulations, documenting them according to the schedule of classification of violations, and referring them to the competent committee.<\/p>\n<p>Secondly: Reviewing and examining records, information, papers, books, files, or any other document related to the classification.<\/p>\n<p>Third: Obtaining copies of the necessary documents related to the offense.<\/p>\n<p>Fourth: Preparing reports on all their observations and observations related to the visits and submitting them to the specialists at the Vice Presidency.<\/p>\n<h4><span style=\"color: #800000;\">Article XVII:<\/span><\/h4>\n<p>Subject to the provisions of Article (16) of the Law, a competent committee shall consider and adjudicate contractors' objections to classification decisions and violations of the provisions of the Law and the Regulations, and approve the penalties stipulated in Article (15) of the Law:<\/p>\n<p>1- The committee shall be formed by a decision issued by the Minister, specifying the head of the committee and the members, provided that the head of the committee is a specialist in Sharia law or regulations.<\/p>\n<p>2- The remuneration of the committee members and the supporting team shall be determined by a decision of the Minister, not exceeding (30,000) thirty thousand riyals per year for each member.<\/p>\n<p>3- The Committee shall be competent to consider the contractors' objections to the classification decisions, violations and penalties prescribed in accordance with Article 15(2) of the Law, through the reports and inspection control reports referred to the Committee or any facts or violations referred to the Committee by any other party.<\/p>\n<p>4- The Chairman of the Committee may carry out the work that assists the Committee in accomplishing its tasks, unless it conflicts with the laws and regulations, such as but not limited to:<\/p>\n<p>Requesting any other party to provide any documents, information, or data related to the violations before the Committee.<\/p>\n<p>B- Summoning the inspector - the author of the seizure report - to hear his statements regarding the violation before the committee.<\/p>\n<p>C.
