Al-Shammari noted the existence of specialized divisions for real estate contributions within the General Court in Riyadh, which have jurisdiction over most cases even if the defendant is outside Riyadh. There is also a liquidation committee that hears cases filed prior to June 22, 1426 AH.<\/p>\n<p>Al-Shammari explained that disputes involving unupdated deeds are not considered, which has contributed to the loss of certain rights, For while some co-owners of jointly held deeds may benefit, other co-owners cannot file a claim for equitable rent or a right of first refusal without updating the real estate deed, Furthermore, some requirements for updating the real estate deed involve jurisdictions linked to other entities\u2014such as Najiz, Ihkam, and the Notary Public\u2014while others fall under the court\u2019s jurisdiction. In my personal experience, all these entities may decline to act, leaving the deed unupdated. Al-Shammari said: \u201cLawsuits alleging damage to real property after the property has been vacated are among the most common cases that lawyers handle.\u201d<\/p>\n<p>Regarding the impact of real estate legislation, Al-Shammari explained that its full implementation will resolve many issues, We are also awaiting the abolition of notary offices and the transfer of all their powers to the virtual notary office, as there are certain complications that have been delaying the updating of some deeds for a long time due to the cumbersome procedures of certain departments.<\/p>\n<p>Al-Shammari advised real estate buyers and sellers not to deal with anyone other than entities and individuals licensed to conduct sales and property transfers, such as notaries and public notaries, and warned that some lawyers draft contracts to notarize the sale of properties that are either mortgaged or held in common, and that proving ownership of such properties presents many obstacles.<\/p>\n<p>@Omarbinmahdi<\/p>\n<p>= =<\/p>\n<h4><span style=\"color: #800000;\"><strong>Firas Al-Haddalq<\/strong><strong>: <\/strong><strong>Failure to Register Lease Agreements... The Most Prominent Issues<\/strong><\/span><\/h4>\n<p>For his part, attorney Firas Al-Haddalq explained that rental disputes and the failure to register contracts on the \u201cEjar\u201d platform are among the most significant obstacles facing attorneys, noting that such contracts are not valid as enforceable instruments and cannot be considered in court proceedings without being registered on the platform, which results in the loss of rights.<\/p>\n<p>Al-Haddalq explained that there are many real estate cases in the courts, including cases involving rent, compensation for damages, ownership, or construction on another person\u2019s land. Some disputes center on the evidence and documentation required to prove the case, and the facts of each case differ from one another.<\/p>\n<p>Regarding the impact of recent real estate legislation on the progress of legal proceedings, Al-Haddalq said: \u201cThe regulations have accelerated the adjudication of cases, such as by making lease agreements enforceable instruments\u2014something that was not the case previously. Among the most notable regulations in the real estate sector are the Evidence Law and the Civil Transactions Law.\u201d.<\/p>\n<p>Al-Haddalq noted that the government has streamlined many regulations and prioritized prompt action to protect people\u2019s rights and finances. He proposed adding additional fields to lease agreements to help make them more precise and enforceable, noting that, under the Ejar platform, if conditions are added to the contract, the lease agreement is not considered a legally enforceable document.<\/p>\n<p>Firas Al-Haddalq offered market participants five tips, which he summarized as follows:<\/p>\n<p>1. Verify the value of the land and ensure it is not built on fill.<\/p>\n<p>2. Verify the warranties and insurance coverage against hidden defects.<\/p>\n<p>3. Regular maintenance of the property.<\/p>\n<p>4. Verify the permits when renting a storefront, as there are a number of properties that do not have all the necessary permits.<\/p>\n<p>5.
