Any amount paid by the buyer or tenant is not considered a deposit unless expressly stated in the contract. If this is not specified in writing, the amount is considered an advance payment toward the purchase price, which the seller or landlord is not entitled to recover if the contract is terminated.<\/p>\n

The seller or lessor must complete the transaction after receiving the deposit. If the transaction cannot be completed due to the buyer or tenant, and there is no defect in the property, the deposit is not refunded.
