If this is not specified in writing, the amount is considered an advance payment toward the purchase price, which the seller or landlord is not entitled to recover if the contract is terminated.<\/p>\n<h4><span style=\"color: #800000;\"><strong>3. Refund of the Deposit<\/strong><\/span><\/h4>\n<p>The seller or lessor must complete the transaction after receiving the deposit. If the transaction cannot be completed due to the buyer or tenant, and there is no defect in the property, the deposit is not refunded. However, if the reason for the failure of the transaction is not attributable to either party, the deposit must be refunded to the person who paid it.<\/p>\n<h4><span style=\"color: #800000;\"><strong>4<\/strong><strong>\u2013 Rights of Real Estate Brokers<\/strong><\/span><\/h4>\n<p>It is important for everyone to know that a real estate broker is not permitted to retain the deposit as security for his rights in the transaction.
