Learn about the amendments to the white land fee system and vacant properties"},"content":{"rendered":"<p>In a new regulatory move aimed at encouraging the use of land and buildings within cities and addressing the phenomenon of real estate monopolies, the Official Gazette yesterday revealed details of the new amendments recently approved to <strong><a href=\"https:\/\/argaamplus.s3.amazonaws.com\/eb134943-b33e-42c6-8c61-cd3ea6024d48.pdf\">White Land Fees System<\/a><\/strong>, which was approved by the Council of Ministers, includes extensive changes, such as bringing vacant properties under the scope of the system and changing its official name to the \u201cWhite Land and Vacant Property Fees System.\u201d.<\/p>\n<p>The amendments reflect the government's commitment to promoting efficiency in the use of <a href=\"https:\/\/amlak.net.sa\/en\/77355\/\">Real estate assets<\/a> Within the urban area, in line with urban development goals.<\/p>\n<h4><span style=\"color: #800000\"><strong>Under the amended regulations, the scope of the definitions has been expanded to include:<\/strong><\/span><\/h4>\n<p>White Land: Any vacant, developable land located within the boundaries of the urban area.<\/p>\n<p>Vacant properties: These are buildings within the urban area that have been left unused for a long period without an acceptable justification, and the fact that they are not being used has a negative impact on the abundance of real estate supply.<\/p>\n<h4><span style=\"color: #800000\"><strong>With regard to the implementation of the amendments, the regulation specifies different effective dates:<\/strong><\/span><\/h4>\n<p>White Land Fees: These fees will take effect as of the date the relevant implementing regulations come into force, provided that the regulations are issued within 90 days of the date the amendments are published.<\/p>\n<p>Vacant Property Fees: These fees will take effect as of the date the relevant implementing regulations come into force, which must be issued within one year of the date the amendments are published.<\/p>\n<h4><span style=\"color: #800000\"><strong>The amendments also included a revision of Article 3 of the regulation, the most notable provisions of which are as follows:<\/strong><\/span><\/h4>\n<p>An annual fee not exceeding 10% of the land\u2019s value shall be imposed, in accordance with the rules set forth in the implementing regulations, on undeveloped land owned by a natural or legal person, with the exception of state-owned real estate.<\/p>\n<p>The Minister of Municipalities and Housing has the authority to determine the scope of application of the fees and the areas covered, provided that the area of the land or group of lands subject to the fees is not less than 5,000 square meters, as specified in the regulations.<\/p>\n<p>An annual tax shall be imposed on vacant properties at a rate equal to a percentage of the market rent, not to exceed 5% of the property\u2019s value, with the exception of state-owned properties.
