{"id":81917,"date":"2025-08-10T17:11:26","date_gmt":"2025-08-10T14:11:26","guid":{"rendered":"https:\/\/amlak.net.sa\/?p=81917"},"modified":"2025-11-25T20:34:32","modified_gmt":"2025-11-25T20:34:32","slug":"%d8%a7%d8%b9%d8%aa%d9%85%d8%a7%d8%af-%d8%ac%d8%af%d9%88%d9%84-%d8%aa%d8%b5%d9%86%d9%8a%d9%81-%d9%85%d8%ae%d8%a7%d9%84%d9%81%d8%a7%d8%aa-%d9%88%d8%b9%d9%82%d9%88%d8%a8%d8%a7%d8%aa-%d9%86%d8%b8%d8%a7","status":"publish","type":"post","link":"https:\/\/amlak.net.sa\/en\/81917\/","title":{"rendered":"Adoption of the schedule of violations and penalties of the Real Estate Contributions Law Millions in fines and referrals to the prosecution"},"content":{"rendered":"<p>The Board of Directors approved<strong><a href=\"https:\/\/rega.gov.sa\/\"> Public Authority for Real Estate<\/a><\/strong> An updated table of violations and penalties under the system<strong><a href=\"https:\/\/amlak.net.sa\/en\/63194\/\"> Real estate contributions<\/a><\/strong> and its implementing regulations, with the aim of promoting discipline and transparency in the sector, according to a report published by the newspaper \u201cUmm al-Qura.\u201d.<\/p>\n<p>The new schedule includes the referral of four serious violations to the Public Prosecution for investigation and prosecution before the competent court, including:<\/p>\n<ul>\n<li>Launch, announcement, or marketing <strong><a href=\"https:\/\/amlak.net.sa\/en\/63170\/\">Real estate contributions<\/a> <\/strong>Or raising funds for it without a license from the Authority or the approval of the Capital Market Authority.<\/li>\n<li>The licensee or the director of the joint venture making any decision that involves an actual or potential conflict of interest without complying with the procedures for addressing such situations.<\/li>\n<li>Selling real estate assets without a certified appraisal from licensed appraisers.<\/li>\n<li>Failure to deposit the financial returns on the contribution directly into the guarantee account.<\/li>\n<\/ul>\n<p>The schedule also stipulates fines ranging from 10,000 to 30,000 riyals for any license applicant or practitioner who provides misleading information, with the possibility of barring them from engaging in any work related to real estate contributions for up to 5 years.<\/p>\n<p>If the licensee, engineering consultant, or certified public accountant borrows from the share capital, a fine of 1% of the amount borrowed, up to a maximum of one million riyals, shall be imposed, and the licensee shall be suspended from any real estate activity for a period not exceeding 5 years.<\/p>\n<p>As for a property owner who fails to transfer ownership to the cooperative after obtaining a license, they will be fined 0.5% of the property\u2019s value, up to a maximum of 500,000 riyals, and the penalty increases to 2%, up to a maximum of one million riyals, if the in-kind share is disposed of during the period specified by the regulation.<\/p>\n<p>The penalties also include a fine of up to 50,000 riyals for anyone who obstructs the procedures for removing a managing director or interferes with his work or that of the consultant and the certified public accountant, along with the possibility of being barred from engaging in any real estate activity for up to 4 years, in addition to a fine of 10% of the value of any unauthorized borrowing or borrowing allocated for irregular purposes, up to a maximum of 5 million riyals.<\/p>\n<p>The schedule also imposes a fine of 5% of the amount collected\u2014up to a maximum of 5 million riyals\u2014for any amounts collected outside the escrow account, in addition to barring the violator from working in real estate investments for up to 5 years.<\/p>\n<p>The regulations require the licensee to disclose any material changes to shareholders;
