{"id":83852,"date":"2025-09-25T15:43:12","date_gmt":"2025-09-25T12:43:12","guid":{"rendered":"https:\/\/amlak.net.sa\/?p=83852"},"modified":"2025-11-25T17:30:39","modified_gmt":"2025-11-25T17:30:39","slug":"%d8%b5%d8%af%d9%88%d8%b1-%d8%a7%d9%84%d9%85%d9%88%d8%a7%d9%81%d9%82%d8%a9-%d8%b9%d9%84%d9%89-%d8%a7%d9%84%d8%a3%d8%ad%d9%83%d8%a7%d9%85-%d8%a7%d9%84%d9%86%d8%b8%d8%a7%d9%85%d9%8a%d8%a9-%d8%a7%d9%84","status":"publish","type":"post","link":"https:\/\/amlak.net.sa\/en\/83852\/","title":{"rendered":"Approval of statutory provisions to regulate the relationship between landlord and tenant"},"content":{"rendered":"<p>In accordance with the directives of His Royal Highness Prince Mohammed bin Salman bin Abdulaziz Al Saud, Crown Prince and Prime Minister of the Kingdom of Saudi Arabia, to start implementing a package of<strong><a href=\"https:\/\/rega.gov.sa\/media-center\/%D8%A7%D9%84%D8%A3%D8%AE%D8%A8%D8%A7%D8%B1\/%D8%A5%D9%86%D9%81%D8%A7%D8%B0-%D8%A7-%D9%84%D8%AA%D9%88%D8%AC%D9%8A%D9%87-%D8%B3%D9%85%D9%88-%D9%88%D9%84%D9%8A-%D8%A7%D9%84%D8%B9%D9%87%D8%AF-%D8%A8%D8%A7%D8%AA%D8%AE%D8%A7%D8%B0-%D8%B9%D8%AF%D8%AF-%D9%85%D9%86-%D8%A7%D9%84%D8%A5%D8%AC%D8%B1%D8%A7%D8%A1%D8%A7%D8%AA-%D9%84%D8%AA%D8%AD%D9%82%D9%8A%D9%82-%D8%A7%D9%84%D8%AA%D9%88%D8%A7%D8%B2%D9%86-%D8%A8%D8%A7%D9%84%D9%82%D8%B7%D8%A7%D8%B9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A-%D9%81%D9%8A-%D8%A7%D9%84%D8%B1%D9%8A%D8%A7%D8%B6-%D8%B5%D8%AF%D9%88%D8%B1-%D8%A7%D9%84%D9%85%D9%88%D8%A7%D9%81%D9%82%D8%A9-%D8%B9%D9%84%D9%89-%D8%A7%D9%84%D8%A3%D8%AD%D9%83%D8%A7%D9%85-%D8%A7%D9%84%D9%86%D8%B8%D8%A7%D9%85%D9%8A%D8%A9-%D8%A7%D9%84%D8%AE%D8%A7%D8%B5%D8%A9-%D8%A8%D8%B6%D8%A8%D8%B7-%D8%A7%D9%84%D8%B9%D9%84%D8%A7%D9%82%D8%A9-%D8%A8%D9%8A%D9%86-%D8%A7%D9%84%D9%85-%D8%A4%D8%AC%D8%B1-%D9%88%D8%A7%D9%84%D9%85-%D8%B3%D8%AA%D8%A3%D8%AC-%D8%B1\/\"> New regulations for the rental market in Riyadh<\/a><\/strong>In response to the challenges that the capital has witnessed over the past years in terms of rising residential and commercial rental prices, the <strong><a href=\"https:\/\/rega.gov.sa\/\">Public Authority for Real Estate<\/a><\/strong> The Council of Ministers issued a Cabinet decision and a Royal Decree approving the statutory provisions to regulate the relationship between the lessor and the lessee, which include the following:<\/p>\n<p>First: Suspending the annual increase of the total rental value in residential and commercial real estate rental contracts (existing or new) in properties located within the urban area of Riyadh for a period of (5) years starting from today's date, 3 Rabi'II 1447 AH corresponding to September 25, 2025 AD, and accordingly the lessor cannot increase the total rental value of the property agreed upon in existing or new contracts as of today's date, and the provisions of the regulation of the annual rental value can be applied to all or parts of other cities, governorates, and centers (if needed to be applied) by a decision The provisions of the regulation of the annual increase in the rental value can be applied to all or parts of other cities, governorates and centers (if needed) by a decision of the Board of Directors of the General Real Estate Authority after the approval of the Council of Economic Affairs and Development.<\/p>\n<p>Secondly: As of today's date, the total rental value of vacant residential and commercial real estate leases within the urban area of Riyadh (that have been previously leased) will be fixed according to the total value of the last \u201crent\u201d contract, and the total rental value for residential and commercial properties (that have not been previously leased) will be calculated as agreed upon between the lessor and the tenant.<\/p>\n<p>Third: Documenting rental contracts in the Ejar network: The lessor in the lease contract that is not registered in the electronic network for rental services \u201dEjar\u201d must apply to register the contract in \u201dEjar\u201d, and the tenant has the right to apply to register the contract in \u201cEjar\u201d, and the other party may object to the contract data before the Public Authority for Real Estate within (60) days from the date of informing him of the registration; if that period expires without objection, the contract data will be valid.<\/p>\n<p>IV: Regulating the controls of automatic renewal in rental contracts: A lease contract (in all cities of the Kingdom) is automatically renewed, unless one party notifies the other party of its unwillingness to renew at least 60 days before the expiration date of the contract, except in the following cases: Fixed-term contracts that have (90) days or less remaining when these provisions come into effect, or in the case of contracts that the parties agree to terminate by mutual consent after the deadline for submitting the notice of non-renewal, and the General Authority for Real Estate may increase the notice period The lessor may not refrain from renewing the contract if the lessee wishes to renew the contract (in properties located within the urban area of Riyadh), and the lessee is obliged to vacate the property except in three cases:<\/p>\n<p>1. Default by the lessee.<br \/>\n2. The existence of structural defects in the property that affect its safety and the safety of the occupants, according to a technical report approved by the legally competent governmental authority.<br \/>\n3. The lessor's desire to use the residential real estate unit for his or her own personal use, or for the use of a first-degree relative.<br \/>\nOr any other cases decided by the Board of Directors of the Public Authority for Real Estate, in accordance with the controls and criteria it sets.<\/p>\n<p><a href=\"https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1.jpg\"><img alt=\"\" loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-83858\" src=\"https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1.jpg\" width=\"1440\" height=\"2560\" srcset=\"https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1.jpg 1440w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1-169x300.jpg 169w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1-576x1024.jpg 576w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1-768x1365.jpg 768w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1-864x1536.jpg 864w, https:\/\/amlak.net.sa\/wp-content\/uploads\/2025\/09\/G1sJP5DXsAAaP_C-scaled-1-1152x2048.jpg 1152w\" sizes=\"auto, (max-width: 1440px) 100vw, 1440px\" \/><\/a><\/p>\n<p>Fifth: The lessor shall have the right to object to the rental value determined in accordance with these provisions in non-existing contracts, in any of the following cases If the real estate unit has undergone substantial structural or structural renovations that affected its rental value, or if the last lease contract for the property was concluded before 2024, and any other cases approved by the Board of Directors of the Public Authority for Real Estate, which prepares the necessary controls and mechanisms to consider and receive the submitted objections.<\/p>\n<p>Sixth: A fine will be imposed on anyone who violates these provisions, not exceeding the amount of 12 months' rent for the real estate unit under contract, with correction of the violation and compensation of the affected person, and the Board of Directors of the General Real Estate Authority shall issue a table of violations and the corresponding fines based on what is stated in these provisions, taking into account the gravity of the violation and its circumstances, and the committees formed in accordance with Article (20) of the Real Estate Brokerage Law promulgated by Royal Decree No. (M\/130) and dated 30\/11\/1443 AH shall be responsible for considering the violations of these provisions and imposing the stipulated fines and penalties. An incentive bonus of no more than (20%) of the amount of the fine collected for any violation of these provisions (the statutory provisions for regulating the relationship between the lessor and the lessee only) is granted to those who report them -The Board of Directors of the Public Authority for Real Estate shall determine the rules for disbursing the rewards and the mechanism for dividing them if there are multiple whistleblowers.<\/p>\n<p>Seventh: What is not specifically stipulated in these provisions: The provisions contained in the Civil Transactions Law promulgated by Royal Decree No. (M\/191) dated 29\/11\/1444H shall apply, and the Council of Ministers may amend these provisions based on the recommendation of the Council of Economic and Development Affairs in light of the reports received from the General Real Estate Authority regarding these provisions.<\/p>\n<p>The directives related to real estate balance stipulated that the General Authority for Real Estate should activate and monitor the new regulatory procedures in accordance with what has been approved in cooperation with the relevant authorities and in line with the implementation plan, in addition to continuing to monitor real estate rental prices and market movement to ensure compliance and the ability to raise any subsequent remedies as new developments arise.The Crown Prince directed to submit periodic reports on the progress of work to implement these rulings, including reports on prices and related real estate indicators.<\/p>\n<p>In order to ensure the effective implementation of the legal measures taken to regulate the relationship between the lessor and the lessee, the General Real Estate Authority and the relevant authorities will publish clarifications and explain the mechanisms taken in this regard and raise awareness about them.<\/p>\n<p>These rulings come as a pivotal step towards rebalancing the residential and commercial rental market in Riyadh, establishing justice and transparency in the contractual relationship between landlord and tenant, and representing an important stage towards providing a fair and safe investment environment that enhances the
