The new decision represents a clear message that the real estate market no longer tolerates abuses or practices that threaten the confidence of investors and dealers, and sets strict controls to ensure the rights of all parties and protect shareholders' funds.<\/p>\n<p>Recently, the board of directors of<strong><a href=\"https:\/\/rega.gov.sa\/\"> Public Authority for Real Estate<\/a><\/strong> A table categorizing the violations and penalties prescribed in the Real Estate Contributions Law, including deterrent measures that in some cases reach referral to the Public Prosecution, large financial fines, and prohibition of practicing the activity for specific periods of time.<\/p>\n<h4><span style=\"color: #800000;\">Offenses Referred to the Public Prosecution<\/span><\/h4>\n<p>The decision included referring four major violations for investigation and prosecution before the competent court:<\/p>\n<ul>\n<li>Offering, advertising, marketing, or raising funds for real estate contributions without the CMA's approval or license.<\/li>\n<li>The licensee or the manager of the real estate contribution takes decisions or actions in light of existing or potential conflicts of interest without adhering to the controls to address the conflicts.<\/li>\n<li>Selling real estate assets without a certified appraisal from licensed appraisers.<\/li>\n<li>Not depositing the proceeds of the contribution directly into the escrow account.<\/li>\n<\/ul>\n<h3><strong>Fines and financial penalties<\/strong><\/h3>\n<ul>\n<li>Providing misleading information prior to licensing: A fine of 10,000 to 30,000 riyals, with a ban on practicing the activity for up to 5 years.<\/li>\n<li>Lending from the capital of the real estate contribution: A fine equivalent to 1% of the amount lent (up to 1 million riyals), with a ban on the activity for up to 5 years.<\/li>\n<li>Disposal of shares in kind: A fine of up to 2% of the value of the disposed quota (up to SAR 1 million).<\/li>\n<li>Obstructing the work of the shareholder's manager or advisors: Initial warning, followed by a fine of 10,000 to 50,000 riyals and a ban on activity for up to 4 years.<\/li>\n<li>Borrowing secured by shareholding funds without authorization: A fine of 10% of the amount borrowed (up to 5 million riyals).<\/li>\n<li>Collecting money outside official channels: A fine of 5% of the amounts (up to 5 million riyals) and banning the activity for up to 5 years.<\/li>\n<li>Failure to disclose material changes: A fine of 10,000 to 70,000 riyals, with a ban on activity for up to 4 years.<\/li>\n<\/ul>\n<h3><strong>Other violations and fines<\/strong><\/h3>\n<p>The table included eleven additional offenses, such as:<\/p>\n<ul>\n<li>Failure to provide periodic reports to shareholders.<\/li>\n<li>Failure of the engineering consultant to supervise the contribution work.<\/li>\n<li>Signing or disbursing sums in violation of regulations.<\/li>\n<li>Failure of the shareholder's manager to distribute profits or disclose material decisions.<\/li>\n<li>Providing misleading information in reports or disclosures.<\/li>\n<li>Failure to enable control officers to perform their duties.<\/li>\n<\/ul>\n<p>Fines for these violations range from SAR 3,000 to SAR 70,000, depending on the size of the contribution (small, medium and large), with the violator obliged to correct the situation within ten days of issuing the penalty.<\/p>\n<p>With this strict regulatory framework, the General Real Estate Authority emphasizes that protecting investors and consumers is a top priority, and that any violations will be met with firm measures to ensure the stability and credibility of the market.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading time: <\/span> <span class=\"rt-time\"> 2<\/span> <span class=\"rt-label rt-postfix\">Minutes<\/span><\/span>In a move aimed at enhancing discipline and transparency in the real estate contributions sector, the Board of Directors of the General Real Estate Authority (GRA) adopted an updated table to categorize violations and penalties, according to the Real Estate Contributions Law and its executive regulations.
