In application of the regulations related to the off-map sales and leasing program, the Ministry of Housing represented by the Wafi program and the Investigation and Public Prosecution Authority signed a cooperation agreement to carry out investigation and prosecution of violations of the regulations related to the sale and leasing of units of real estate projects on the map.
Rules of Procedure

The Secretary General of the Off-Map Sales Committee, Mohammed Al-Ghazwani, explained that the meetings of the two sides concluded by agreeing on the procedural rules for potential violations of off-map sales projects, so that the Ministry of Housing, in light of Articles (27/37) of the Criminal Procedures Law, will prepare arrest reports for violations and refer each case file to the branch or department in the area where the violation occurred within 24 hours.

Ghazwani pointed out that the implementation of this agreement and the initiation of the investigation and prosecution authority will start from the beginning of Jumada Al-Thani 1438H, before the implementation of the Council of Ministers" decision on the new regulations for the sale or rental of real estate units on the map, which will come into effect on the fifth of Rajab 1438H. The Ministry of Housing, represented by the "Wafi" program, will tighten control over real estate projects to implement the controls, and refer any fraud, cover-up, or procrastination in fulfilling the rights of depositors or buyers of real estate units on the map, or in the event that the violation continues without correction, or in the case of practicing the activity of real estate development on the map without a license Those who submit false data or documents to the Ministry of Housing or the Committee, or who knowingly aid, assist, offer or sell units in unlicensed or fictitious off-plan real estate projects, or embezzle, unlawfully use or squander payments made for the purposes of establishing real estate projects.

The law also penalizes public accountants who deliberately issue incorrect reports as a result of the audit of the financial position or who deliberately conceal material facts in his report, or whoever certifies consultants on project documents knowing that they are not valid or meet the requirements, noting that if any of the previous acts are discovered, the committee will coordinate The committee will coordinate with the competent authorities to seize fixed or movable assets, including securities and investment portfolios, then refer the violator to the Investigation and Public Prosecution Authority, and if any of the violations are proven by the Investigation and Public Prosecution Authority, the violator will be referred to the Criminal Court to be sentenced with the appropriate penalty.
