The Minister of Municipal and Rural Affairs and Housing, based on the powers legally vested in him. Having reviewed Supreme Order No. (7262) dated 8/2/1437H approving the visions and directions of the Ministry of Housing (formerly).
Having reviewed the regulation of real estate offices issued by Cabinet Decision No. (334) dated 7/3/1389H.Having considered Cabinet Resolution No. (405) dated 9/22/1437H requiring real estate brokers to register all rental contracts for residential and commercial units electronically through the electronic network approved by Cabinet Resolution No. (131) dated 3/4/1435H, the establishment of which was approved by Cabinet Resolution No. (131) dated 3/4/1435H.
After reviewing the Executive Regulations of Real Estate Offices issued by the Minister of Commerce Decision No. (1704) dated 16/5/1398H, and after reviewing the Minister of Commerce Decision No. (1) dated 2/1/1417H regarding the amendment of Articles (2 and 6) of the Executive Regulations of Real Estate Offices.
After reviewing the minutes signed on 6/4/1438 AH between the Ministries of (Commerce and Investment and Housing) (former) regarding the transfer of the supervision of real estate offices to the Ministry of Housing (former), and after reviewing Ministerial Resolution No. (216) dated 5/1/1442 AH regarding the approval of the schedule of penalties related to real estate offices.
Based on the exigencies of public interest, he decided the following:
First: Article (12) of the above-mentioned Real Estate Offices Executive Regulations shall be amended to be as follows:
1- The competent department shall notify the violator of the recommended penalty, after conducting the necessary procedure by the competent team, after reviewing the seizure report.
2- A committee (or more) of at least three members - at least one of them from the Public Authority for Real Estate, including a specialist in Sharia or regulations, to consider the objections submitted by the concerned parties to the penalties notified against them, and the objection shall be submitted in writing to the committee within thirty days from the date of notification of the recommended penalty, and the committee shall decide on this objection within thirty days from the date it is submitted to it, and the decision to establish the committee states the rules and procedures of the committee's work and procedures.
3- If the person notified of the recommended penalty does not submit the objection in accordance with paragraph (2) of this Article, or the Committee recommends that his objection is not accepted, the Minister's decision shall be issued with the penalty.
Second: This decision repeals anything that contradicts it.
Third: This decision shall be published in the Official Gazette and shall enter into force thirty days after the date of publication.
