The Ministry of Justice issued a circular in which Minister of Justice Dr. Walid Muhammad Al-Samaani stated that the court’s role in judgments regarding the transfer of real estate ownership ends with the issuance of the judgment, provided that the transfer of title be carried out through a notary public, based on a request submitted by the beneficiary to the notary public to transfer title, in accordance with the court’s judgment, without the need for the parties to be present.
The circular emphasized that the role of the judicial courts is limited to hearing the case in the event of a dispute or a request to establish ownership and determine «shares,» and the judicial review process ends with the issuance of final and binding judgments; at this point, the judicial review process concludes, while notary offices are responsible for completing the procedures for transferring ownership of the property, inquiring about records, registering deeds, and transferring ownership in accordance with the operative part of the judicial ruling issued by the judicial court.
Thus, the decision defines the roles of the judicial chambers and notary offices in a way that prevents overlap, such that the judge’s role is limited to hearing the case and ruling on it by establishing, transferring, or apportioning ownership, while notary offices are responsible for implementing the judgment in accordance with its terms.
