The Minister of Justice issues a circular on the conditions and cases of registering leases within the network

Minister of Justice Walid bin Muhammad Al-Samaani issued a circular regarding the registration of lease agreements concluded outside the Ejar network; in it, he clarified the conditions and requirements for their notarization, emphasizing that agreements concluded outside the network do not produce legal effects, The circular, a copy of which was obtained by “Amlak,” noted the importance of taking into account lawsuits related to such contracts concluded after the date of the circular.

Conditions for Registering a Contract Within the Network

1- The contract must be registered within the rental network.

2- Both parties to the contract (landlord and tenant) must agree to the model contract via the available means.

3- The following information and requirements must be met:

– The names of the landlord and tenant.

– The ID numbers of the landlord and tenant, or their authorized representatives.

The real estate unit.

– The term of the lease.

– The rent amount.

– Payment frequency (monthly, annually, semi-annually, quarterly).

– Details of the leased property.

– Any additional information and attachments.

– The conditions and requirements set by Ejar Network for registering contracts.

Cases for registering a contract on the platform:

Case 1:

A contract concluded outside the network between a lessor and a lessee, with all parties agreeing to register the contract on the network using the standard contract template.

In this case, the contract is concluded through the platform, and the contract concluded through the platform becomes enforceable.

Case 2:

A contract concluded outside the network between a landlord and a tenant, where all parties agree to register the contract on the network, but in a format different from the standard form; it is then documented on the rental network.
