How to renew, modify, suspend and revoke construction licenses

The minister approved new implementing regulations governing municipal licensing procedures, which require the use of an electronic platform, approvals from the Civil Defense, and the payment of fees.

The Umm al-Qura newspaper reported that the Minister of Municipal, Rural Affairs, and Housing, Majid Al-Hogail, to approve the executive regulations for the Municipal Licensing, which replaces the executive regulations for the Municipal Licensing Procedures Law issued on 2 Jumada Al-Awwal 1438 AH, along with any amendments thereto, and repeals any provisions that conflict with them.

According to what was published by Umm Al-Qura Newspaper in its issue published yesterday, Friday, these regulations repeal all provisions that conflict with them and shall take effect from the date of their publication in the Official Gazette.

According to Article 4 of Chapter 2 of the Executive Regulations of the Municipal Licensing Procedures System, the steps for renewing construction permits and their amendment, suspension, and revocation are as follows:

How to Renew, Amend, Suspend, and Revoke Building Permits

The renewal, amendment, cancellation, and suspension of a building permit shall be in accordance with the following:
1- The building permit is renewed by the Secretariat/ municipality upon request by the permit holder through the electronic platform, after fulfilling the service requirements—and obtaining approval from the Civil Defense depending on the nature and type of the building permit—and paying the municipal fees and fines for the building permit, if any.
2- The building permit is amended by the Secretariat/ municipality upon request by the license holder through the electronic platform, after fulfilling the service requirements—and obtaining approval from the Civil Defense based on the nature and type of the building permit—and paying the municipal fees and fines for the building permit, if any.
3- The building permit shall be suspended in the following cases:
‌a- If the building permit was issued in violation of the law, regulations, or relevant instructions and requirements.
‌b- If the license holder violates the terms of the license as prescribed by law.
‌c- If the license holder requests it, this shall be permitted on a one-time basis, and the suspension period shall be added to the term of the building permit, provided that the total suspension period does not exceed one year.
D. If government agencies request it, provided that the request is justified and based on a legal document authorizing them to do so.
‌E. If deemed necessary for reasons that the Secretariat/Municipality deems to affect safety (health, urban, economic), the matter shall be referred to the Secretary for a decision.
4- A building permit shall be revoked for the following reasons:
‌A- Upon request by the permit holder after payment of municipal fees and fines related to the building permit, if any.
‌b- If necessary for reasons affecting safety (health, urban, economic) by decision of the Minister or his delegate.
‌c- If required by the public interest by decision of the Minister.
