In implementation of the Royal Decree issued in this regard on 8/2/1437 AH, which transferred the supervision of landlords“ councils to the Ministry of Housing, the Ministry of Social Affairs has completed the statutory procedures, to hand over all files related to the landlords” councils to Housing.
According to the decision, everything related to all files and records of the 16 existing owners" associations and six associations under establishment were transferred to the Ministry of Housing permanently according to the latest minutes between the two parties prepared on Friday 12/3/1437 AH to become from this date the concerned authority for these councils: 16.0pt; font-family: "Arial","sans-serif"; color: #333333;">.
The formation of these associations comes in accordance with the system of ownership and sorting of real estate units and its executive regulations, which aims to facilitate citizens in their various categories in owning real estate units and sorting them for use for various purposes such as residential apartments, shops, administrative offices and the like, and opening new horizons for national investment in the field of establishing residential and commercial complexes and their investment, while providing an opportunity for all citizens to pool capital and form owners" associations that are registered with the Ministry of Housing, the concerned party currently, where the owners' association sets a regulation to guarantee the property and its proper utilization.
The law and its executive regulations include many controls related to the sorting of real estate units and the inclusion in the title deeds of the descriptions of the land plot, its boundaries and shape and the descriptions of the real estate unit, its boundaries and its geometric shape, as well as defining the common parts of the building whose ownership is common among all owners in proportion to the contribution of each of them to the capital and expenses that fall under the maintenance of common parts, and the system included the procedures for transferring ownership before the competent authorities when documenting contracts and declarations and issuing related deeds and so on.
