The Public Authority for Real Estate has released the draft model of the usufruct registration in the real estate register, and the draft model of the usufruct deed, via the “Reconnaissance” platform; in order to enable the public, government agencies and the private sector to express their views and comments on them before adopting them.<The Authority explained that the substantive provisions of the usufruct right are regulated in the Civil Transactions Law, indicating the scope of the right and the rights and obligations of its parties, noting that the registration of the usufruct right in the real estate registry comes in application of the provisions of the Real Estate Registration Law, based on Article 13, which requires the registration of all transactions that would create any of the original or subsidiary rights in kind, and these rights are not effective and productive of their judicial and administrative effects except by this registration.<The draft usufruct registration form in the real estate registry includes items related to the registration of the usufruct right, the rights and obligations of the beneficiary and the owner, and others, in addition to the draft form of the usufruct registration deed and the data and details it contains.
This aims to enhance the efficiency of the procedures of Real Estate Registration, raise the accuracy of the real estate registry, ensure the protection of the rights of usufruct parties and organize them in a clear and disciplined manner. The Authority invited all interested parties from the public, government agencies and the private sector to review the amendments to the regulation in Research and provide comments and suggestions on them.

The Authority stressed its keenness that the draft model for registering usufruct in the real estate registry contributes to achieving the effectiveness of the real estate sector, keeping pace with the development of the real estate market and enhancing the confidence of dealers and investors in the Saudi real estate sector.
