The regulations governing the monitoring of state-owned properties and the removal of encroachments provide for the formation of a main committee in each regional emirate, chaired by a representative from the regional emirate and comprising representatives from the Ministries of Justice, Municipal and Rural Affairs and Housing, Environment, Water and Agriculture, and the General Authority for State Property, provided that the rank of the representatives of those entities is no lower than the tenth rank or its equivalent. The main committee may form subcommittees in the governorates and districts whenever necessary and delegate to them any of the main committee’s tasks, except those related to issuing removal orders.
The Main Committee shall be responsible for monitoring and protecting state properties from any encroachment and preserving them within the scope of the region’s administrative supervision; issuing the necessary decisions to remove encroachments on state properties, and having them approved by the Emir of the region; supervising the implementation of removal operations after the necessary decisions have been issued and ensuring that no excesses occur during implementation; and preparing monthly reports on the progress of its work and the challenges it has faced, and submitting them to the Emir of the region.
The headquarters of the main committee shall be located in the Emirate of the region, which shall provide it with the necessary support to carry out its work, Each main committee shall be responsible for monitoring state properties, protecting them from any encroachment, and preserving them within the administrative scope of the region in accordance with the mechanisms necessary to fulfill its assigned mission, provided that this includes reports from ministries and other government agencies, reports received from natural or legal persons, and information provided by aerial and satellite imagery.
Duties of the Main Committee
In accordance with the rules for monitoring state-owned properties and removing encroachments, the Main Committee carries out the tasks assigned to it, based on inspecting the site of any state-owned property subject to encroachment, halting any encroachment on the encroached-upon state property, and preparing a report stating that the committee has verified the encroachment and reviewed any available documents or records related to the site, which all committee members sign in accordance with the procedures set forth in these rules.
The encroacher must remove the encroachments at his own expense within a period not exceeding ten days from the date of notification; in the event of his refusal or delay, the encroachment shall be removed under the supervision of the Main Committee. Government agencies—each within its respective jurisdiction—shall cooperate with the Main Committee in removing the encroachment, and the Committee may enlist the assistance of the private sector in providing the equipment required for removal.
Payment of Removal Costs
According to the rules for monitoring state-owned properties and removing encroachments, the encroacher is required to pay the costs of removal and all compensation and expenses resulting from the encroachment, including compensation for the removal of raw materials and the costs of restoring the site to its pre-encroachment condition, and the penalties and sanctions prescribed by law shall be applied to the encroacher on state property.
The application of these rules shall not prejudice the right of any aggrieved party affected by the removal—whether a natural or legal person—to appeal to the relevant authorities or competent courts, as the case may be, regarding any excess in enforcement that violates the provisions of these rules.
Pursuant to these rules, the Governor of the region or his delegate may request the competent authority to suspend services to the violator if the situation so requires, and the competent authority shall comply with such request in accordance with the provisions governing the suspension of services.
The rules repeal all provisions related to the work of government land monitoring and encroachment removal committees, except for the penalties imposed on violators and the remuneration of government land monitoring and encroachment removal committees.
The rules aim to protect state-owned real estate from any encroachment, to preserve it, and to take the necessary measures to remove such encroachments.
