Amlak publishes the text of the three royal decrees related to the budget of the fiscal year 1437 AH / 1438 AH - (1)

<The Custodian of the Two Holy Mosques Salman bin Abdulaziz Al Saud on Monday issued three royal decrees regarding the state's general budget for the fiscal year 1437H/1438H, namely Royal Decree M/14, Decree M/15 and Decree M/16. Amlak newspaper lists the texts of these orders sequentially.

Having reviewed Articles (72, 73, 76, 78) of the Basic Law of Governance issued by Royal Decree No. (A/90) dated 27/8/1412H.

Having reviewed Articles (25, 26, 27) of the Council of Ministers Law promulgated by Royal Decree No. (A/13) dated 3/3/1414 H.

<Having reviewed Royal Decree No. (M/6) dated 12/4/1407 AH, which stipulates that the State's fiscal year begins on the tenth day of Capricorn each year. <Having considered Cabinet Resolution No. (157) dated 12/9/1420H.

After reviewing the Supreme Decree No. (Kh/S-46325) dated 10/9/1425 AH regarding the distribution of the surplus revenues of the fiscal year 1424/1425 AH.

After reviewing Royal Decree No. (A/227) dated 16/7/1426 AH regarding the distribution of the surplus revenues of the fiscal year 1425/1426 AH.

<Having reviewed Royal Decree No. (A/149) dated 11/11/1427H on the distribution of the surplus revenues of the fiscal year 1426/1427H. <Having reviewed Royal Decree No. (A/177) dated 11/21/1428 AH regarding the distribution of the surplus revenues of the fiscal year 1427/1428 AH. <Having reviewed Royal Decree No. (A/1) dated 3/1/1433 A.H. on the distribution of the surplus revenues of the fiscal year 1432/1433 A.H.
Having reviewed Royal Decree No. (A/18) dated 2/17/1434 A.H. on the distribution of the surplus revenues of the fiscal year 1433/1434 A.H.

<Having considered Cabinet Resolution No. (153) dated 17/4/1435H. Having considered the decision of the Council of Economic Affairs and Development No. (1-14/37/Q) dated 10/3/1437H. <Having reviewed the data on the state revenues and expenditures for the fiscal year 1437/1438 submitted in the letter of His Excellency the Minister of Finance No. (1990) dated 15/3/1437H.
Having considered Cabinet Resolution No. 91 dated 17/3/1437 A.H. We hereby ordain the following:
First:

<The State's revenues and expenses for the fiscal year (1437/1438) are estimated and approved as follows:-
1 - Revenues are estimated at (513,803,803,000,000) five hundred and thirteen billion eight hundred and three million riyals.

2.1 - Revenues are estimated at (513,803,000,000) five hundred and thirteen billion eight hundred and three million riyals.

<Expenditures are estimated at (840.000.000.000) eight hundred and forty billion riyals.
3 - The deficit is estimated at (326.197.000.000) three hundred and twenty-six billion one hundred and ninety-seven million riyals.

Secondly :

All revenues shall be collected in accordance with financial regulations and shall be deposited in a current account of the Ministry of Finance at the Saudi Arabian Monetary Agency (SAMA). Agencies whose statutes provide for financing their expenditures from their revenues shall open another account at SAMA for expenditures and transfer between the two accounts according to a mechanism to be agreed upon between the Ministry of Finance, SAMA and the concerned entity.

Third :

<Authorizing the Minister of Finance to add the amounts necessary for disbursement on the projects funded from the surplus revenues of each of the fiscal years (1424/1425), (1425/1426), (1426/1427), (1427/1428), (1432/1433), (1433/1434) and (1434/1435) issued by Supreme Order No. (Kh/S/S/46325) ) dated 10/9/1425 AH, Royal Order No. (A/227) dated 7/16/1426 AH, Royal Order No. (A/149) dated 11/11/1427 AH, and Royal Order No. (A/127) dated 11/11/1427 AH No. (A/177) dated 11/21/1428 AH, Royal Decree No. (A/1) dated 1/3/1433 AH, and Royal Decree No. (A/18) dated 2/17/1434 AH.
Fourth: Expenditures shall be disbursed in accordance with the general state budget and its instructions. Fifth :

1. Any surplus in the State's general budget revenues shall be transferred to the State's general reserve account.
2 - It is not permissible to withdraw from the state's general reserve except by royal decree in cases of extreme necessity related to the supreme interests of the state, without prejudice to the provisions of paragraph (3) of item (I) of the Council of Economic Affairs and Development Decision No. (1-14/37/Q) dated 10/3/1437 AH, and the Minister of Finance is authorized to borrow accordingly.



Sixth:

The authority to withdraw from the general budget support allocation shall be in accordance with the procedures in paragraph (4) of item (I) of the Council of Economic Affairs and Development Resolution No. (1-14/37/Q) dated 10/3/1437H.


VII:

<Government agencies included in the state's general budget shall submit to the Ministry of Finance an estimate of monthly revenues and expenditures for the entire fiscal year 1437/1438 at the line item level within thirty days from the date of notification of the budget.
VIII::

<1 - The authority to transfer from the savings of programs and projects shall be in accordance with the procedures in paragraph (5) of item (I) of the Council of Economic Affairs and Development Resolution No. (1-14/37/Q) dated 10/3/1437H.
2 - Transfers between budget chapters and branches - except for programs and projects - shall be made by a decision of the Minister of Finance based on a request from the competent minister or the head of the entity with an independent budget. 3 - Transfers between line item allocations - except for what is mentioned in paragraphs (1) and (2) of this item - shall be made by a decision of the competent minister or the head of the entity with an independent budget, provided that what is transferred from or added to any item does not exceed half of its original allocation, except for the salary items within the first section (workers" compensation) and more than half of the allocation, the transfer shall be made by a decision of the Minister of Finance.




Ninth:

It is not permissible to use the appropriation for other than what it was allocated for, or to issue an order to commit or disburse in excess of the appropriation, or to commit any expenditure for which there is no budgetary provision, and the rules and procedures prescribed by law shall be applied to those who violate this.


Tenth:

No resolution may be passed or contract entered into that would create an obligation for a future fiscal year except for the following:
1 - Contracts with continuous or periodic implementation, such as leases, labor, services, food supply, medicines and medical supplies, and consultancy contracts for which annual appropriations are repeatedly allocated, and that the annual contract value is within the budget appropriations and the first fiscal year's appropriation is used as a measure to determine the value of the contract and is not linked to the amount approved for other purposes.
2- Contracts for operation and maintenance programs and project implementation provided that the obligation is within the approved costs of each program or project.


XI :

If it appears during the fiscal year (1437/1438) that there are amounts that have been committed in previous years, the Minister of Finance or his representative may authorize the disbursement of those amounts from the appropriations of the fiscal year (1437/1438)


XII :

The administrative formations of each entity shall be approved as per the state's general budget, and may not be amended except by a decision of the Council of Ministers.



Thirteenth:

Employees, employees and workers may only be appointed or promoted against positions approved in the state's general budget and in accordance with the terms and conditions set forth in the applicable laws and regulations.



Fourteenth:

<It is not permissible during the fiscal year to create positions, ranks or grades other than those approved in the general budget of the State.
2 - Except for the appointment of ministers, ministerial and senior officials, and positions created in accordance with the conditions stipulated in the Temporary Positions Law. 3. It is not permissible during the fiscal year to raise the ranks and grades approved in the state's general budget.
4. By a decision of the Minister of Civil Service, job titles may be modified in accordance with the requirements of job classification rules, and ranks may be reduced, based on the recommendation of a committee composed of representatives from the Ministry of Finance, the Ministry of Civil Service and the relevant authority.
5. By a decision of the Minister of Finance, approved positions may be transferred between chapters and branches of the budget and within the same administrative formation, based on the recommendation of a committee composed of delegates from the Ministry of Finance, the Ministry of Civil Service and the relevant entity.



Fifteenth:

Supervisory bodies shall follow up on the implementation of the relevant regulations, decisions and instructions.
XVI:

<The Minister of Finance shall issue the necessary instructions to implement this budget within the limits of the rules stipulated in this decree.

XVII:

<His Highness the Deputy Prime Minister, the ministers and the heads of the concerned independent agencies - each in their respective fields - shall implement this decree.
