The official spokesperson of the Ministry of Justice, Sheikh Dr. Mansour bin Abdulrahman Al-Qaffari, said that notaries are specialized in documenting contracts and declarations, indicating that some mortgage dealers resort to forcing the owner to empty the mortgage in their favor, and documenting the mortgage in customary papers to ensure their right to sell the property directly in case the debtor defaults, in violation of the mortgage system, indicating that notaries were - and still are - conducting mortgage documentation for any natural or legal person, according to legal provisions and general instructions regulating this, according to forms designated for this purpose. All notaries have been instructed to work in accordance with the mortgage system registered under Circular (13/T/4688) dated 10/9/1433 AH. Al-Qaffari called on all mortgage dealers to document the mortgage with the competent notary to ensure the benefit of the procedures in the Execution Law and the Registered Mortgage System in case the debtor fails to pay, by executing on the mortgaged property in accordance with the procedures specified in the Execution Law.
