For his part, lawyer and former judge Ali Al-Mushrifi explained in a press statement that this order is specific to lands that have a removal order by the Government Land Control and Encroachment Removal Committee and does not include all lands. He added that the evidence of this is that the royal order came in response to inquiries received from the emirates of the regions regarding the removal or not, as the generous order to address specific cases, and accordingly, the lands that do not have a removal order are not covered by this order.
Musharrafi added: “It is excluded from removal: Residential land whose owner has placed his hand on it and built a dwelling and became inhabited, this is dealt with in accordance with the Holy Order No. 571 on 26/3/1405, which states: ”If a citizen manages to establish a house for himself on unowned land and it is proven that he needs that house and does not have a dwelling, the matter of that house shall be considered If it does not interfere with organizational lines or public utilities, and if it does not cause harm or danger to anyone or provoke collective issues and is not intended to cause new migration, it shall remain for its owner and the value of the land shall be taken from him, doubled according to its actual value at the time of assessment.“ This order added a new restriction: The development must not be after the issuance of Royal Decree No. A/218 on 25/3/1441.
This comes before the expiration of the deadline set by the state to document properties through the «Ihkam» platform, which ends on 5/5/1443 AH.
