The Minister of Justice and President of the Supreme Judicial Council, Sheikh Dr. Walid bin Mohammed Al-Samaani, expressed his gratitude and appreciation to the Custodian of the Two Holy Mosques, King Salman bin Abdulaziz Al Saud, and His Royal Highness Prince Mohammed bin Salman bin Abdulaziz Al Saud, Crown Prince, Deputy Prime Minister, and Minister of Defense– may God protect them – for issuing Evidence System.
The Minister praised the interest and support of His Royal Highness Prince Mohammed bin Salman bin Abdulaziz Al Saud, Crown Prince, Deputy Prime Minister, and Minister of Defense – may God protect him – for developing a system of specialized legislation that reinforces the principles of justice and transparency and contributes to achieving comprehensive development. He highlighted the contents of His Highness’s statement on the occasion of the issuance of the Evidence Law, and what was stated therein regarding the development of the legislative system in the Kingdom; thereby contributing to raising its quality and enhancing the performance of judicial bodies, given that these laws are fundamental pillars in achieving transparency and justice, and will bring about a major qualitative leap in the judicial legislative system and establish principles grounded in fixed references in judicial practice—as His Highness noted.
He explained that among the most prominent objectives of the Evidence Law are the stability of judicial rulings and the expedited resolution of disputes; so that the judge may devote himself to recording, describing, and establishing the facts, and then applying the relevant legal provisions to the facts, in addition to achieving preventive justice by encouraging the parties to document their contractual actions in a manner that preserves rights and contributes to the maintenance of legal statuses.
He noted that the system of evidence will contribute to increasing confidence and assurance in contractual obligations, due to the existence of a governing and regulating text for legal statuses, and the creation of a modern model for judicial legislation consistent with the objectives of Sharia and international conventions.
He concluded his remarks by stating that specialized legislation is built on several foundations, the first of which is its basis in the provisions, rules, and objectives of Islamic Sharia, followed by consideration of economic, social, and other realities, while also taking into account comparative international studies and experiences. and thus these regulations were developed into a comprehensive, integrated framework that will have a significant positive impact on the judiciary and on society in general.
